Terms of service

The agreement between you and BOFU Content. Plain language, and shorter than most.

1. The service

BOFU Content researches bottom-of-funnel keywords, writes articles, and publishes them to systems you connect. It also finds backlink opportunities, sends outreach from a mailbox you connect, and reports on whether AI assistants cite your brand. These terms are an agreement between you and FunnelStrategist LLC (“we”, “us”), and they cover the marketing site at bofucontent.us and the application at app.bofucontent.us.

2. Your account

You need an account to use the service, you must give accurate details, and you are responsible for what happens under your account and for keeping your password safe. You must be able to enter a contract, and you must not use the service if the law where you live forbids it.

3. Plans, trials and payment

• Plans are Starter ($99/month), Growth ($499/month) and Authority ($999/month), each billed monthly in advance.
• New subscriptions begin with a paid trial: $3 charged immediately, covering three days and up to three articles. When the trial ends, the plan you chose begins billing at its normal price automatically.
• You can cancel at any time from the billing portal. Cancelling during the trial means you pay only the $3 and nothing further. Cancelling later stops the next renewal; the current period runs to its end.
• Prices exclude any taxes that apply where you are. Payments are processed by our payment processor; we never see or store your card details.
• We do not generally give refunds for time already served, but if the service failed to do what it promised, write to us — we would rather fix it than argue about it.

4. Fair use of automation

Two features act on the world on your behalf, so they carry obligations you accept when you use them.

• Outreach email. Messages are sent from your own mailbox and are your responsibility. You must comply with anti-spam law wherever your recipients are, including CAN-SPAM, GDPR and PECR as applicable. Do not use outreach for bulk unsolicited marketing, and honour opt-outs. We may suspend outreach for an account that generates spam complaints.
• Publishing. Articles are published to systems you connect using credentials you supply. You are responsible for reviewing what goes out under your name, and for the accuracy of claims about your own product.

5. Content and ownership

You own the articles, keyword plans and other output the service produces for you, and you keep all rights in the material you give us. You grant us only the permission needed to run the service — to process your content, publish it where you tell us, and store it.

We own the software, the interface and everything else that makes up the service. These terms do not transfer any of that to you.

6. What AI-generated content is and isn't

Articles are generated by AI from real search data. That means two honest caveats. First, no ranking, traffic or revenue outcome is promised — search engines decide what ranks, and nobody can guarantee results. Second, generated text can contain mistakes, and it can make claims about your product or a competitor's that need checking. Review before publishing, particularly anything comparative. The approve-before-publish setting exists for this reason.

7. Third-party services

The service depends on third-party providers — cloud infrastructure, AI language models, search data and payment processing — as well as any CMS, mailbox or Search Console property you connect. When you connect one of your own accounts, you also accept that provider's terms. If a provider changes or withdraws access, some features may change or stop, and we are not liable for their acts or outages.

8. Acceptable use

Do not use the service to publish unlawful, deceptive or infringing material; to impersonate anyone; to attack, probe or overload our systems or anyone else's; to resell the service without our agreement; or to generate content for sites you do not control or have permission to publish on.

9. Availability

We work to keep the service running but do not promise uninterrupted availability. We may change, add or remove features. If we make a change that materially reduces what a paid plan provides, we will tell account holders in advance.

10. Liability

To the maximum extent the law allows, the service is provided “as is”, and we are not liable for indirect or consequential loss, lost profits, lost rankings, or lost data. Where liability cannot be excluded, our total liability for any claim is limited to what you paid us in the twelve months before the claim arose. Nothing here excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to cover us against claims arising from content you publish through the service, from your use of outreach email, and from your breach of these terms.

12. Suspension and termination

You may close your account at any time. We may suspend or close an account that breaches these terms, that generates spam complaints, or that puts the service or other customers at risk. On termination your right to use the service ends; you can export or delete your content beforehand, and we delete it as described in the privacy policy.

13. Changes to these terms

We may update these terms. The date above shows when, and material changes are notified to account holders by email. Continuing to use the service after a change means you accept it.

14. Governing law

These terms are governed by the laws of [jurisdiction], and the courts of [jurisdiction] have exclusive jurisdiction over any dispute.
